1. Definitions
In these Terms & Conditions, the following terms carry the meanings below:
- "Agreement" — these Terms & Conditions, together with any tenancy agreement between you and Teratai Living.
- "Service" — the property rental advisory, introduction, and tenancy management services provided by Teratai Living.
- "We / Us / Our" — Teratai Living, operating in Kuala Lumpur, Malaysia, registered under the Valuers, Appraisers, Estate Agents and Property Managers Act 1981.
- "You / User" — any individual or organisation accessing our website or using our services.
- "Property / Residence" — any rental property made available through Teratai Living.
- "Content" — all text, images, and information published on our website.
2. Acceptance of Terms
By accessing our website or submitting an enquiry, you confirm that you have read these Terms and agree to be bound by them. You must be at least 18 years of age and legally capable of entering binding agreements under Malaysian law. Where you act on behalf of an organisation, you confirm you hold the authority to bind that organisation.
3. Service Description
Teratai Living provides property rental advisory and tenancy management services across selected properties in Kuala Lumpur. We act as an intermediary between property owners and prospective tenants. Our services encompass property introduction, tenancy facilitation, and resident support throughout the term of any rental arrangement. We are members of the Malaysian Institute of Estate Agents (MIEA) and operate within the regulatory framework of Malaysian property law.
Availability of specific properties is subject to change. We make no representation that any particular residence will be available at the time of enquiry.
4. Enquiries and Viewings
Submitting an enquiry through our website, by email, or by telephone is entirely non-binding. No tenancy arrangement, financial obligation, or right of access arises from an enquiry alone. Property viewings are arranged at our discretion and subject to availability. We reserve the right to decline enquiries where the stated requirements cannot be met by any property in our current portfolio.
5. User Responsibilities
When using our website or engaging our services, you agree to:
- Provide accurate and complete information in all enquiries, forms, and tenancy documentation
- Notify us promptly of any changes to information previously provided
- Treat all properties with care during viewings and site visits
- Refrain from reproducing, distributing, or commercially exploiting content from our website without written consent
- Refrain from using our website or services for any unlawful purpose
6. Tenancy Arrangements
6.1 Tenancy Agreements
All tenancy arrangements are formalised through a written tenancy agreement signed by both parties. No tenancy comes into existence until a formal agreement is duly executed. We encourage all prospective tenants to review the tenancy agreement carefully and, where appropriate, to seek independent legal advice before signing.
6.2 Tenancy Duration
Our properties are offered on monthly rental terms, with a recommended minimum of three months. Specific duration terms are set out in the individual tenancy agreement. Extensions are negotiated in advance and confirmed in writing.
6.3 Rent and Payments
Monthly rental amounts are stated in Malaysian Ringgit (MYR). Utility costs — including electricity, water, and internet — are billed separately at actual usage unless otherwise specified. Deposit arrangements, payment schedules, and any additional charges are documented in the tenancy agreement prior to signing.
6.4 Renewal and Termination
Either party may terminate a tenancy in accordance with the notice terms set out in the individual tenancy agreement. Early termination conditions and notice periods are specified per tenancy. Renewal discussions are initiated by our team with appropriate advance notice prior to the end of each term.
7. Property Access and Conduct
Tenants are expected to use the property for residential purposes only and to maintain it in good order throughout the tenancy. Alterations, subletting, or use of the property for commercial purposes requires prior written consent from the property owner, facilitated through Teratai Living. Tenants are responsible for any damage caused beyond fair wear and tear during their occupancy.
8. Household Staff
Where household staff form part of a property arrangement (as described per property), those staff members work under conditions coordinated by Teratai Living and the property owner. Tenants are expected to engage with household staff in a respectful and reasonable manner. Concerns regarding staff conduct should be directed to Teratai Living, not managed directly with individual staff members.
9. Intellectual Property
All content on our website — including photographs, descriptions, branding, and design — is the property of Teratai Living or its licensors. You are granted a limited, non-exclusive, non-transferable right to access and view the site for the purpose of exploring our services. No right to reproduce or commercially exploit site content is granted without explicit written consent.
10. Disclaimers
Our website content is provided in good faith for general information purposes. While we take care to ensure accuracy, we make no formal warranty as to the completeness or currency of any information provided. Property descriptions, pricing, and availability are subject to change. We recommend confirming all details directly with our team before making any decisions.
We do not guarantee specific outcomes from any tenancy arrangement. Teratai Living's role is to introduce, facilitate, and support — not to guarantee results beyond what is stated in any executed agreement.
11. Limitation of Liability
To the extent permitted by Malaysian law, Teratai Living's liability in connection with our services is limited to the fees paid to us in relation to the specific matter giving rise to a claim. We are not liable for indirect, consequential, or incidental losses arising from use of our services or website. Nothing in these terms excludes liability for fraud, death, or personal injury caused by our negligence.
12. Indemnification
You agree to indemnify Teratai Living against any claims, costs, or losses arising from your misuse of our website, breach of these Terms, or violation of any applicable law in connection with your use of our services.
13. Dispute Resolution
In the event of a dispute, we encourage an initial informal discussion with our team to seek resolution. Should informal resolution not be possible, disputes will be subject to the jurisdiction of the courts of Malaysia, governed by Malaysian law. Where both parties agree, mediation through an accredited Malaysian mediation service may be pursued prior to formal proceedings.
14. General Provisions
- Entire Agreement: These Terms, together with any executed tenancy agreement, constitute the full agreement between the parties.
- Severability: If any clause is found to be unenforceable, the remaining clauses remain in force.
- Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
- Assignment: You may not assign your rights under these Terms without our prior written consent.
15. Changes to These Terms
We may update these Terms from time to time. The revised version will be published on this page with an updated effective date. Continued use of our services following publication of updated Terms constitutes acceptance of those changes.
